On December 9, 2024, the Colorado Family and Medical Leave Insurance Program (FAMLI) announced that all employers with Colorado employees must update their total employee headcount for 2025 on the My FAMLI+ Employer portal by February 28, 2025. If the annual total employee headcount was not updated by February 28, the FAMLI Division will assume an employer has 10 or more employees and will be required to send in 0.9% of wages each quarter in 2025. This means that if an employer had nine or fewer employees for 2024, they were required to update their headcount for 2025 in order to continue paying 0.45% of wages.
By way of background, Colorado employers with 10 or more employees are required to send in 0.9% of wages every quarter, and those with nine or fewer employees will be responsible for sending 0.45% of wages. For example, if an employer has 15 employees nationwide, and eight working completely in Colorado, the employer would be required to pay the 0.45% employer's share and collect and remit the 0.45% of the employee's share for each of those eight employees.
The new requirement took effect on February 28, 2025.
